Abstract

The primary goal of this work is to carry out a study of legislative changes that it has gone experiencing the violence of gender in the Criminal jurisdiction according to our Spanish Legislation from the point of view practitioner-legal so much to International as National level. Of the analysis of the legislative evolution in connection with the violence of gender, can conclude that when it comes to the legislation up to now significant advances have been achieved, has been considered to the violence on the woman as a freelance criminal offence, with a special processing. Additionally the order of protection, but it does not seem the solution to the problem, given that many women that had order of protection have murdered by its couples or excouples. So that this order is efficient is necessary to complement her with other means that all in all will be the vigilance. The creation of jurisdictional bodies specific to discuss the violence of gender also is an achievement; given that because of the remarkable rise of this seals make it necessary to specialize to the judges. Courts of violence on the woman and the teams of forensic assessment created by the IT 1/2004 have supposed a step more in this fight against the violence of gender. Possible solutions would come thanks to a reform of the current regulations, with a great tightening of penalties, to give great effectiveness to the order of protection to have the security of that they are not going to repeat new violence episodes.
