Resumo
The first part of this work is devoted to the study of the conflicts that might arouse between the right to personal data protection recognized in the article 18.4 CE and the right of the political representatives to request and obtain the information from the public administrations, that is required to fulfill their functions, enshrined in the article 23.2 CE. The preferred value of the second of these rights is taken as a starting point because it is deemed essential for the control functions of representatives and members of the local corporations and because of its direct connection with the democratic principle. In this regard, it is suggested that the Constitutional Court's legal doctrine on the conflict between freedoms of expression and information and the rights to honour and privacy is fully applicable to the balancing of the two rights mentioned above, and that the enforcement of precautionary measures to prevent risks to the right of personal data protection against the information requests of the representatives is not compatible with the right of the article 23.2. In the second part of the study a reflection is made on the impact caused on the dialectical tension between the two referred rights by the incorporacion into our legal system of the principle of transparency, access to public information and good governance, through the Act 19/2103, December 9
