Abstract

Act 11/2011, of 20 May, on the reform of the Act 60/2003, of 23 December, on Arbitration and of the regulation of institutional arbitration in the General Administration of the State, introduces two new articles about the intra-enterprise arbitration in corporate enterprises (articles 11 bis and ter of the Act of Arbitration). In the present work we analyze the article 11 bis of the Act of Arbitration, drawing upon the study of the arbitrability of the corporate disputes, the form and the content of the intra-enterprise arbitration agreement, as well as the majorities required for the inclusion of this kind of clauses in the company by-laws.
