On an Area of Freedom, Security and Justice without any internal borders, the effective prosecution of serious cross - border crime has become one of the priorities of the EU ́ s criminal law policy. In that s ense, the prevention and settlement of conflicts of criminal jurisdiction between member states of the EU, currently stated on art. 82. 1 b) and art. 85. 1 c) TFEU, plays a key role on the effectiveness of the whole EU ́ s response against transnational crime. However, the current legal framework, primarily composed by the Framework Decision 2009/948/JHA on prevention and settlement of conflicts of jurisdiction and by the Eurojust Decision, relies on a non - binding settlement proceeding based on the exchange of information and the establishment of direct consultations between the national authorities involved. Due to the lack of compulsory powers, national judicial authorities are in fact solely responsible for coming to an agreement. This paper aims to analyze t he weaknesses and loopholes of the present legal framework, pointing out the convenience of adopting a new European Union legislation dealing with this matte
