Abstract
The article raises, above all, the problem of the opportunity to constitutionalize the right to legal protection of health as a fundamental right in the strict sense, concluding affirmatively. In current Spanish constitutionalism, it is a constitutional «principio rector» and a legal right. It is proposed, then, in a possible reform of the Constitution, to convert it into a fundamental right of legislative configuration. Second, the work raises the convenience of explicitly recognizing primary health care in the constitutional text.
