The penalty of deprivation of liberty and its execution must be studied and understood in its integration in the broader framework of the penal system. Society and jurists are not so very far away from feeling oblivious towards events within the four walls of a prison. However, progressive affirmations of the legality of the circumstances in which the enforcement of a prison sentence takes place is also evident, even going so far as to affirm its constitutional relevance. But other increasingly relevant dimensions mean that importance may be shown as the connection of both the system and penitentiary law with the theory of punishment and its link with the effective measurement of the sentence.
