The adoption of Directive (EU) 2015/2302 and its transposition into the Spanish legal system by RDL 23/2018 provide a new perspective to the question of subjects responsible for non-compliance with the benefits agreed in the combined travel contract in which priority is given traveler protection, consolidated at the community level as a vulnerable consumer. This is deduced from the preparatory work for Directive (EU) 2015/2302, which resulted in a waiver of the objectives of maximum harmonization for the benefit of consumer protection, but also from the continuity solution adopted by the Spanish legislator, the responsibility solidarity of organizers and retailers.
