Abstract

The IV Book of LEC establish special declarative processes, treating in Title I those that deal with capacity, filiation, marriage and minors. The generation of public interest in all of them leads to the replacement of the operative principles and the contribution of parties, usually informers of civil proceedings, by those of the official nature and official investigation, which are typical of criminal proceedings. This situation gives rise to interesting procedural particularities in terms of evidence, powers of disposal, limitations on the publicity of proceedings and the presence of the Public Prosecutor’s Office, among others.
