Resumen

The decolonization of former province of Occidental Sahara required to give an answer to the problem of nationality of people who were until then under the pro- tection of Spanish State. But even nowadays many Saharans do not have nationality. Those who formerly were in possession of documents issued by Spanish authorities have sometimes been recognized as nationals by Spanish courts. But the last key judgement in this field, STS 207/2020, 29th May refuses the possibility that those who were born in former Spanish Sahara are recognised as national origin. After this judgement the issue becomes topical again, as it constitutes one of the worst resolved chapters of our colonial past. This paper is focused on the analysis of the problem and its possible solutions
