Abstract

The new CC regulation continues to speak of prohibited acts as well as collision of interests. lf the general rule is the principie of presumption of capacity, how is it possible that art. 226 has not been modified? In these cases, is it not possible to speak of voluntary permission or authorization? judicial authorization is still required for many of its acts, in line similar to the existing regulation. lt seems that the CC has wanted to approach the principies of the CRPD but with certain precautions, for this reason I intend to point out certain limitations of action that are still considered for the validity of the acts celebrated by the curator or tutor, by continuing to demand authorization or even judicial approval, or appreciating conflict of interest in self-contracting unless proven otherwise.
