Resumen

The transposition of the Whistleblower Directive is going to make it mandatory for corporations to have a record keeping of the reports received revealing infractions committed within the organization, and the investigations carried out. In accordance with the jurisprudence regarding the right against self-incrimination, this new legal requirement will cause the internal material of legal persons, generated by virtue of the reporting channel, to be accessible to the courts, in such a way that they will be forced to provide documents that may contribute to their own sentence.
