Abstract
This paper deals with the controversial judgement n.o 816/2023 of May 29 of the Supreme Court regarding the origination fee of a mortgage loan following the line set by the Court of Justice of the European Union through the judgement of March 16, 2023 in case C-565/21. This judgement of the SC responds to the request for three preliminary rulings by the Supreme Court through the order of September 10, 2021.
