Abstract
The aim of this paper is to analyze the system of possession and acquisition of animals, after the modifications introduced in the Civil Code by the Law 17/2021, of December 15. For that purpose, first a study is made of the new legal status applicable to the possession of animals, as well as the concept of pet which has a special regulation. Then, the different modes of acquisition and loss of property and the special regime applicable to the action of division of animals in co-ownership are examined. Finally, some reflections are made on the possible limitations to the possession of pets in rented homes and in flats under the horizontal property legal regime.
