Abstract

At the present the debate on the effective protection of human rights of same-sex couples each day is of vital importance, since even legal developments and constitutions in different countries, LGBTI community (Lesbian, Gay, Bisexual, Transgender and Intersex), remain still discriminated against, labeled and stigmatized. Therefore, the debate in question is a priority of global nature, such as homophobic demonstrations have been present throughout history, a fact that can not be tolerated in models of companies touting gender equality, sexual identity and the right to the difference. Therefore, this article aims to make a comparative study in European and American has been analyzing how the evolutionary process of such rights.
