Resum

The study begins with the analysis of the conflict which occurs between the holder of the rights of the work protected by copyright and those who intend to use it, for instruction or research purposes, followed by a brief reference to possible solutions. Afterward, it is expounded the illustration for instruction and research, as an exception of copyright (article 32 TRLPI, sections 3 and 4, recently amended by Law 21/2014). It concludes with a reference to the regulation of quotation (article 32.1 TRLPI), currently restricted to instruction and research purposes; it must be analysed in relation to the assumptions not covered by the illustration.
