Abstract
This work deals the recent Judgment of January 25, 2024 of the Court of Justice of the European Union Ninth Chamber regarding the prescription for the claim of expenses derived from the formalization of a mortgage loan following the different lines marked by the various Provincial Court of our country. This judgement definitively responds to the request for several preliminary rulings raised by the Provincial Court of Barcelona through an order dated December 9, 2021.
