Abstract
Through this communication we intend to tackle a complex social phenomenon, too often studied singulary, as that of cohabitation. It supposes an extramarital union, which can be between single people, single and married people, widowed people or religious and, in each of these versions, it usually responds to different personal, family and social realities and situations. As well as the social and religious and legal valuation of the men and women involved. The speeches articulated in the courts indicate that, although all of them had acted against the sacrament, their degree of transgression was not the same, nor was the scandal that their acts could cause and, therefore, their sentences were also different.On the other hand, cohabitations have not been seen in the same way in all times and cultures, and specifically, our study will focus on Castile, in the 18th century, in order to assess the impact that legal enlightenment could have on judicial treatment of this crime.
